Terms and conditions of sale
These terms govern the sale of mobile data plans in eSIM form by SimGoFly.

Article 1 — Purpose
These general terms and conditions of sale (hereinafter the "Terms") govern the sale of mobile data plans in eSIM form (hereinafter "Plans") offered by SimGoFly via the website https://simgofly.com (hereinafter the "Site").
Any order for a Plan on the Site implies unreserved acceptance of these Terms.
Article 2 — Definitions
In these Terms, the following terms have the meaning set out below:
- eSIM: a virtual SIM card embedded in a compatible device, enabling a mobile data plan to be activated without a physical card.
- Plan: a mobile data subscription that can be downloaded and activated via an eSIM, for a specified duration and data volume.
- Customer: any individual who places an order for a Plan on the Site.
- Provider: eSIMerge, the technical partner that supplies the Plans offered on the Site.
- AgentaOS: the third-party payment provider responsible for processing payments (https://agentaos.ai).
Article 3 — Products offered
SimGoFly offers for sale mobile data Plans usable in various destinations around the world. Each Plan specifies the geographical area(s) covered, the data volume included and the validity period.
The Plans are provided by eSIMerge. SimGoFly acts as a reseller and is not the technical provider of the mobile data.
Article 4 — Pricing and payment
Plan prices are displayed in euros (EUR), Moroccan dirhams (MAD), US dollars (USD) and British pounds (GBP) depending on the Customer's selection. Payment is always charged in US dollars (USD).
Payment is made online by credit card via AgentaOS's secure payment system. SimGoFly does not store any card data. The exact amount debited may vary slightly due to the currency conversion applied by the card issuer.
Article 5 — Order and delivery
An order is confirmed once payment has been approved by AgentaOS. The Plan is delivered digitally: a QR code and/or installation link is displayed on the confirmation page and is accessible in the Customer's account area.
Delivery is immediate following payment confirmation. SimGoFly cannot be held responsible for delivery delays caused by the Internet or the payment system.
Article 6 — Plan activation
The Plan must be activated by the Customer by following the provided instructions. Activation consists of scanning the QR code or manually entering the activation code on a compatible device.
The Plan is activated for the first time when installed on a device. Its validity period begins from the date of activation. A Plan that has already been activated may not be refunded, except as provided for in Article 8.
Article 7 — Customer obligations
The Customer undertakes to:
- Verify the compatibility of their device before ordering (see the Compatible Devices page on the Site).
- Provide accurate information when placing an order.
- Follow the activation instructions provided.
- Use the Plan in accordance with the declared destination.
- Not resell, redistribute or share the Plan with third parties.
Article 8 — Right of withdrawal
In accordance with applicable law, the Customer has a withdrawal period of fourteen (14) days from the date of the order to exercise their right of withdrawal, without having to provide any reason.
However, the right of withdrawal cannot be exercised if the Plan has been activated or used before the end of the withdrawal period. Activation of the eSIM on a device is considered as use. The Customer is informed of this before completing the order.
Article 9 — Legal guarantees
SimGoFly is bound by the legal guarantee of conformity for digital goods. In the event of a Plan not conforming to its description (inability to activate, data not as described), the Customer may request termination of the contract or a reduction in price, in accordance with Articles L.224-25-12 et seq. of the French Consumer Code.
Article 10 — Liability
SimGoFly shall not be held liable for:
SimGoFly declines all liability for financial loss arising from the inability to use the Plan for reasons beyond its control.
- Incompatibility between the eSIM and the Customer's device.
- The quality or availability of the mobile network at the travel destination.
- Service interruptions attributable to the Provider or network operators.
- Activation or use of the Plan by a third party.
Article 11 — Amendment of the Terms
SimGoFly reserves the right to amend these Terms at any time. The applicable Terms are those in force at the time of the order.
The Customer will be informed of any material amendment by notification on the Site.
Article 12 — Governing law
These Terms are governed by French law. In the event of a dispute, the parties shall endeavour to reach an amicable settlement. Failing that, the dispute shall be submitted to the competent courts of Paris, France.
